LAW - 675 Transnational Litigation

This course focuses on the role of courts - in the United States and in some European Union countries - in resolving transnational, private law disputes. Topics covered will address suing foreign defendants in the United States court system, including consideration of personal jurisdiction, taking of evidence, anti-suit injunctions, and the extra-territorial effects of U.S. law. It will also cover suits by foreign plantiffs in U.S. courts and forum non conveniens. It will address litigation under the Foreign Sovereign Immunities Act and the Act of State Doctrine. Finally, it will also address enforcement of foreign judgments. Prerequisites: Civil Procedure (LAW-501) and Evidence (LAW-633).
