LAW - 896 Law and the Visual Arts Seminar


(3 hrs.)

Introduces students to the full range of legal issues that arise concerning works of art, the art market, and the art world. Topics to be covered include the fate of works of art in wartime, the international trade in stolen and illegally exported cultural property, artistic freedom, censorship and state support for art and artists, copyright, moral rights and trademark rights, collectors and the art market, and art museums and their collections. Students will consider how the law has dealt with the profound question of what is art and also examine the practical legal problems of visual artists and the commercial art world relating to the protection, acquisition, exhibition, and sale of art works. Major themes of the course will be the policy balance between public and private interest, the impact of law on heritage, and the role that law plays in shaping cultural policy. Farley, J.
